In exchange for the services of Palate as specified in this contract, the client will pay to Palate a price per person attending this event. We ask for an estimated guest count to begin the clients contract. Your guest count is allowed to decrease by 10% one month prior to your event. If your guest count is going up Palate asks that you promptly advise us so we can make necessary adjustments. Payment for Palate’s service can be made payable by check or by debit card or PayPal. Your deposit it made to secure your date and pay for goods it is non refundable. Palate requires the remainder of the payment one week before your event date or we will charge you a late fee of $250.00.
Palate takes your time and our time very seriously. We set a start and stop time to service as that is what Palate quoted you on to feed your guests. If for any reason the Client needs Palate to stay longer or prevents Palate from finishing service resulting in Palate having to stay later, there will be a late fee charged for our time.
CHECK: A check can be made payable to Palate and can be mailed to 2454 Alamo Ln Apt B Santa Fe, NM 87507, or delivered to Palate’s location.
DEBIT CARD: Palate will also accept payment via debit card. Palate accepts most cards

Palate’s total cost includes but is not limited to: food cost, prep, food display, equipment, set up and cleanup of Palate’s items and New Mexico state sales tax.
Menu & Venue
Palate reserves the right to make small changes to the menu if key ingredients are unable to be sourced due to reasons beyond the control of the Parties. Palate is not responsible for any allergens. Palate can and will provide meal options for those with meal preferences when the client informs Palate ahead of time for the need. Palate is not a certified vegetarian, vegan, gluten free kitchen but works hard to maintain high standards and keep special request meals uncontaminated.
Palate will need to have access to the Venue at least 2 hours before the event to set up and park.Palate has full permission to park Palate’s food truck in an area that is convenient and reasonable for caterer, while maintaining a safe area. Either the client or coordinator must attend to discuss parking and power with Palate.
Client is solely responsible for all costs and/or deposits relating to use of the Venue, and for obtaining any necessary permissions, authorizations or other requirement of Palate providing service at the venue.
Insurance and Indemnification
Palate maintains general liability insurance relating to Palate’s services at the event. However, Client will indemnify and hold harmless Palate for any damage, theft, or loss of Palate’s property occurring at the event, caused by any of Client’s guests.
If the client needs to cancel the event, client must provide written notice to Palate along with any required cancellation fee described in this catering contract. Client understands that upon entering into this contract, Palate is committing time and resources to this event and this cancellation would result in lost income and lost business opportunities on an amount hard to precisely calculate. Therefore the following cancellation limitations will apply. If client requests cancellation of this contract 30 days prior to the event date Palate will keep 20% of the total cost. If cancellation happens 14 days before event Palate will be entitled to 50% of the total cost. If cancellation happens 6 days before the event Palate will be entitled to 100% of the total cost. If Palate cannot fulfill its obligations under this contract for reasons outside of its control, Palate will refund the cost after the deposit and will send the client a list of potential caterers who we feel can accommodate what you are looking for. Palate will not be responsible for any additional damages or compensation under these circumstances.
If an issue arises each party will allow the opposite party time to resolve any issue. Each party will withhold from posting anything negative about each other. Parties are able and allowed to post positive and memorable posts on social media outlets. Palate is given permission to use approved photos by the client for marketing purposes.

Jurisdiction and Venue
This contract will be interpreted according to the laws of the state of New Mexico and any legal action must be filed in the county of
Santa Fe in the state of New Mexico.
Seal the Deal
This document, along with its exhibits and attachments, constitutes the entire agreement between parties. Once deposit has been made and/or Palate has begun catering your event this contract
is legally binding.
